Patent-infringement suit dismissed

Chiropractic Economics June 10, 2008

June 10, 2008 — Nordic Naturals Inc., Metagenics Inc., and J.R. Carlson Laboratories announced that they have agreed to dismiss the patent infringement suit, Nordic Naturals Inc. v. J.R. Carlson Laboratories Inc. and Metagenics Inc., filed by Nordic Naturals on May 2, 2007, in the U.S. District Court for the Northern District of California.

 

Under the terms of the stipulated dismissal, Nordic Naturals’ claims for patent infringement and unfair competition under the Lanham Act were dismissed with prejudice.

 

Metagenics’ and Carlson Laboratories’ declaratory relief claims for noninfringement were dismissed with prejudice, and their affirmative defenses and declaratory relief claims for invalidity were dismissed without prejudice. Each party agreed to bear its own attorneys’ fees and costs.
