February 24, 2013 — The U.S. Department of Health and Human Services (HHS) recently released its final rule on essential benefit design — virtually reconfirming the administration’s initial policy that shifted determination of the issue to the states.
The rule did not touch upon the all-important subject of provider non-discrimination, Section 2706 of the Patient Protection and Affordable Care Act, but HHS did state that the provision will be addressed in a separate rule. ACA’s Health Care Reform Task Force is reviewing the new rule and will be relaying any concerns directly to HHS.
