New Jersey PIP schedule in ‘stay’
The New Jersey Appellate Court has granted a stay in the implementation of the new personal-injury protection (PIP) fee schedule and amendments to the Office of Administrative Law. The existing PIP regulations will remain in effect until the stay is lifted by the court. The new PIP schedule was set to be in effect Oct. 1.
The Alliance for Quality Care, Inc., a coalition of healthcare societies formed to represent all healthcare professionals with regard to the proposed regulations, filed suit with the appellate division to obtain the stay on numerous legal grounds.
The Alliance will now litigate its claims that the Department of Banking and Insurance failed to implement the fee schedule in accordance with New Jersey law.
The Association of New Jersey Chiropractors (ANJC) is a member of the Alliance. ANJC was opposed to the amendments and fee schedule because it says:
- Neuromuscular re-education and therapeutic activities now fall within the $99 daily cap;
- Decompression treatment must now be reported as mechanical traction pursuant to CPT 97012; and
- Low-level laser therapy must now be reported as infrared therapy pursuant to CPT 97026 instead of an unspecified physical therapy code.
