More doctors can say ‘I’m Sorry’ without legal worries
Bills in Rhode Island and eight other states that would allow doctors to apologize to their patients when something goes wrong without the threat of plaintiffs using their apologies against them in court, particularly as an admission of guilt, are now up for consideration, the Associated Press reported.
According to the American Medical Association, at least 27 other states have passed “I’m sorry” laws. Apology laws vary state-by-state, sometimes putting a time limit on “safe” apologies or distinguishing between oral and written apologies.
Many Rhode Island trial lawyers oppose the apology bill because they feel it could prevent them from using some internal hospital medical-error reports as evidence, the AP noted.
